Q. What does “No Win – No Fee” mean?

A. In a 'No Win, No Fee' agreement your Solicitor will only be paid if the claim is successful and recover costs from your opponent. You retain 100% of the compensation award.

If your claim fails

You do not have to pay any of the other side's legal costs. The “No Win No Fee” agreement gives you protection throughout your claim and your Solicitor will not charge you.

That means throughout your claim you pay no charges to your Solicitor or anyone else, win or lose.

* There is an exception, which is that if you act unreasonably for example refuse to attend a medical or are dishonest or make a fraudulent claim, the Solicitor would be entitled to seek to recover costs from you.

Q. How is your service free to me?

A. Simply because should the Solicitors decide they can act for you and you are happy for them to do so, the Solicitors will pay me a referral fee. If the Solicitor decides not to act for you, or you do not wish to instruct them I earn nothing.

It may be that the Solicitors will instruct me to carry out further Investigations and this work is paid for by the Solicitors.

Q. What are the advantages to me for using your service?

A. There are many advantages to you. Many people are nervous or unsure about claiming for the consequences of suffering an injury through no fault of their own, or feel they cannot explain details properly to a Solicitor. You have the opportunity to discuss the circumstances of your claim in person if you wish and ask questions with an experienced Investigator who will put you at ease and gather all the necessary information from you and present the facts to the Solicitor on your behalf.

There may be instances where gathering evidence at an early stage can strengthen a claim. For example if you are injured as a result of a recent fall in a public place, where appropriate I will obtain evidence of the hazard, by taking photographs and measurements at an early stage, often before repairs are carried out.

It may be that due to work commitments you are unable to speak to Solicitors who work normal office hours. I am able and willing to work “unsocial hours” including evenings and weekends at any time to suit your convenience.

Q. Do you advise me in any way?

A. No, although I can answer questions. Any advice to you is left in the hands of those that are qualified to give it, in other words the Solicitors appointed to represent you.

My area of expertise is that I am an Investigator and evidence gatherer of many years experience in the Public and Private Sector. I recognise the possible trauma of suffering an injury and pursuing a claim. I elicit information by placing Clients at ease and asking relevant questions and where appropriate obtain photographic and other evidence.

Q. It all seems rather confusing. I thought it was going to be easy!

A. It is! Most of the effort is carried out on your behalf, from my initial investigation to the Solicitors taking care of all the legal aspects through to conclusion. Your accident circumstances and consequences are unique to you. Because the profession is regulated it is necessary to act in compliance of the rules, but I can explain these to you in plain English and in a way that can be understood and that is relevant to your claim.
